These Terms of Service govern your use of my8data.com and are provided by:

2. Order Processing via Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By completing a purchase, you also agree to Paddle's Buyer Terms.
3. Services
my8data.com provides a cloud-based statistical analysis platform specialising in:
- Measurement System Analysis (MSA) – Type 1, 2, 3, 4, 5, 6, 7
- Statistical Process Control (SPC)
- Machine and Process Capability Analysis (MFU)
Access to the platform is provided as a Software-as-a-Service (SaaS) via subscription. The specific features available depend on your subscription plan.
4. Account Registration
To use the platform you must create an account with a valid e-mail address. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must be at least 18 years old to register. You agree to provide accurate and complete information and to keep it up to date.
5. Subscription and Payment
Subscriptions are billed in advance on a monthly or annual basis depending on the plan selected. All payments are processed by Paddle.com as Merchant of Record. Prices are displayed inclusive of applicable taxes. Subscriptions renew automatically unless cancelled before the end of the current billing period.
You may cancel your subscription at any time through your account settings or by contacting us at roland.schnurr@my8data.com. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time except as set out in our Refund Policy.
6. Free Trial / Beta Access
During any free-trial or beta period, access is provided free of charge. We reserve the right to modify, suspend or terminate the trial or beta at any time without notice. At the end of a trial period, continued access requires a paid subscription.
7. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of applicable laws;
- Attempt to gain unauthorised access to any part of the platform or its infrastructure;
- Reverse-engineer, decompile or disassemble any part of the software;
- Resell or sublicense access to the platform without written permission;
- Upload malicious code or content that infringes third-party rights.
8. Intellectual Property
All content, software, algorithms and branding on my8data.com are the exclusive property of Roland Schnurr or its licensors and are protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes during the subscription term.
Data you upload or generate within the platform remains your property. You grant us a limited licence to process your data solely for the purpose of providing the service.
9. Data Protection
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable German data protection law. For full details please refer to our Privacy Policy.
10. Availability and Changes
We aim for high availability but do not guarantee uninterrupted access. We reserve the right to modify, update or discontinue features at any time. Material changes to the service or these Terms will be communicated by e-mail or in-app notification at least 14 days before taking effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Roland Schnurr shall not be liable for any indirect, incidental, special or consequential damages arising out of your use of the platform. Our total cumulative liability shall not exceed the fees paid by you in the three months preceding the event giving rise to the claim. These limitations do not apply where liability cannot be excluded under mandatory German law (e.g. for intent or gross negligence causing personal injury).
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Consumer protection rights that cannot be contractually waived under the law of your country of residence remain unaffected. The place of jurisdiction is Offenburg, Germany, to the extent permitted by law.
